How Jardines Galleries collects, uses, stores, shares, and protects your personal information — in full compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). This policy also governs entry to our website giveaway as a promotional competition under the Consumer Protection Act.

Who we are — the Responsible Party

For the purposes of POPIA, the Responsible Party is Jardines Galleries, a division of R Ungerer (Pty) Ltd (“we”, “us”, “our”), operating the website jardinesgalleries.co.za and trading as a dealer in coins, banknotes, bullion, and related collectibles.

We determine the purpose of, and means for, processing your personal information, and we are accountable for compliance with POPIA across everything described in this policy.

Our POPIA commitment

We process all personal information lawfully and in line with the eight conditions for lawful processing set out in POPIA. We hold ourselves to each of them:

  • Accountability We ensure these conditions are met at the point of, and during, processing.
  • Processing Limitation We process only with a lawful basis, minimally, and for as long as justified.
  • Purpose Specification We collect for specific, explicitly defined, lawful purposes.
  • Further Processing Limitation Any further use stays compatible with the original purpose.
  • Information Quality We take steps to keep your information accurate and up to date.
  • Openness We tell you what we collect, why, and document our processing.
  • Security Safeguards We protect your information against loss, damage, and unauthorised access.
  • Data Subject Participation You may access, correct, delete, and object — as set out below.

Information we collect

We collect only what we need for the purposes described in this policy:

  • Identity & contact data — name, email, phone number, delivery and billing address.
  • Order & transaction data — items purchased, order history, and payment confirmation status (we do not store full card numbers).
  • Compliance data — identity documentation where required by law, including under the Financial Intelligence Centre Act (FICA/FIC).
  • Giveaway entry data — the details you submit when entering our promotional competition (see Section 5).
  • Technical & usage data — IP address, browser type, device, and cookie data when you use the website (see Section 7).
  • Communications — correspondence you send us by email, form, or message.

We collect information directly from you wherever possible. Where we obtain it from another source, we will tell you, unless an exemption under POPIA applies.

Why we process it — purpose & lawful basis

We process your personal information only where POPIA permits it — that is, with your consent, to perform a contract with you, to comply with a legal obligation, to protect a legitimate interest, or where otherwise authorised by law. Our purposes are:

  • To process, fulfil, and deliver your orders, and to handle returns and refunds.
  • To verify identity and meet our FICA/FIC and other statutory obligations.
  • To administer the giveaway / promotional competition and contact winners.
  • To respond to your enquiries and provide customer support.
  • To send you marketing communications — only where you have opted in (see Section 6).
  • To detect, prevent, and address fraud, abuse, and security incidents.
  • To keep records we are legally required to retain.

The giveaway — promotional competition

Jardines Galleries runs a giveaway on this website. It is a promotional competition under Section 36 of the Consumer Protection Act 68 of 2008 (CPA), read with the CPA Regulations, and the personal information you submit to enter is processed strictly under POPIA and this policy.

Full competition rules are prepared before the competition opens and are available free of charge to any participant on request, and to the National Consumer Commission on written request.

How entry works — and what it costs

  • Free to enter. No purchase is required and no payment or consideration is charged to enter, other than your own standard data or connectivity costs.
  • Entry does not improve or depend on buying anything from us.
  • Winners are selected by lot or chance, fairly and at random, from all valid entries.
  • The draw is overseen and certified by an independent person — Reghardt Ungerer — as required by the CPA.
  • You will never be required to attend a prize-giving; if any event is offered, you may decline it and still receive your prize.

How we handle your entry information

  • Purpose: entry data is used only to run the competition, verify eligibility, conduct the draw, contact and announce winners, and meet our record-keeping duties.
  • No bundled marketing. Entering does not sign you up for marketing. Any marketing consent is a separate, optional opt-in (see Section 6), and refusing it does not affect your entry.
  • Winner records: where required, we retain a signed acknowledgement of the prize, the winner’s identity number, and the date of receipt, together with the rules and marketing records.
  • Retention: competition records are retained for at least 3 years after the competition ends, as the CPA requires; thereafter they are securely destroyed or de-identified in line with POPIA.
  • Eligibility integrity: the directors, members, employees, agents, and their immediate family of Jardines Galleries and any associated supplier may not win, in line with the CPA Regulations.

Where the giveaway is also run on a third-party platform (for example a social network), that platform’s own rules apply in addition to these, and the platform is not a sponsor of the competition.

Consent & direct marketing

In line with Section 69 of POPIA, we send electronic direct marketing (email or SMS) only where you have given your consent by opting in, or where you are an existing customer and the marketing relates to our own similar products — and even then, only until you opt out.

  • Every marketing message includes a clear, free way to unsubscribe.
  • You may withdraw marketing consent at any time, at no cost, by emailing info@jardinesgalleries.co.za.
  • Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal, and does not affect order, compliance, or giveaway processing.

Cookies & website data

Our website uses cookies and similar technologies to operate the store, remember your basket and preferences, keep the site secure, and understand how the site is used.

  • Strictly necessary cookies keep core features working and cannot be switched off.
  • Functional and analytics cookies help us improve the site and are used in line with your browser and consent settings.
  • You can manage or block cookies through your browser settings; some features may not work correctly if you do.

Who we share it with

We do not sell your personal information. We share it only where necessary, and only with parties bound to protect it. Under POPIA, parties that process information on our behalf are Operators and must process it solely on our instructions and keep it secure:

  • Couriers and postal services — to deliver orders and prizes.
  • Payment providers — to process and verify payments securely.
  • Grading and authentication bodies (such as NGC, PMG, PCGS) — where you ask us to submit items.
  • IT, hosting, and email-platform providers — to run the website and communications.
  • Professional advisers and authorities — where required by law, regulation, or to oversee the giveaway.

Cross-border transfers

Some of our service providers may process information outside South Africa. Where this happens, we transfer your information only in line with Section 72 of POPIA — that is, where the recipient is subject to laws or binding agreements that provide an adequate, comparable level of protection, where you have consented, or where the transfer is necessary to perform or conclude a contract in your interest.

Security & breach notification

We apply appropriate, reasonable technical and organisational measures to safeguard your personal information against loss, damage, unauthorised access, and unlawful processing, and we keep these measures under review.

If we have reasonable grounds to believe your personal information has been accessed or acquired by an unauthorised person, we will notify the Information Regulator and you as soon as reasonably possible after discovering the compromise, as required by Section 22 of POPIA, so that you can take protective steps.

How long we keep it

We keep personal information only for as long as necessary for the purpose it was collected, or for as long as the law requires us to keep it:

  • Transaction and tax records — for the periods required by South African tax and company law.
  • FICA/FIC compliance records — for the period required by that legislation.
  • Giveaway records — for at least 3 years after the competition ends, as the CPA requires.
  • Marketing data — until you opt out or ask us to delete it.

When we no longer have a lawful basis to keep your information, we securely destroy, delete, or de-identify it.

Children & special information

We do not knowingly process the personal information of a child (a person under 18) without the consent of a competent person, such as a parent or legal guardian. Entry to the giveaway is open only to entrants who meet the stated minimum age. If you believe we hold a child’s information without proper consent, contact us and we will address it.

We do not process special personal information (such as race, health, religious or philosophical beliefs, or biometric data) unless POPIA specifically permits it or you have given your consent.

Your rights as a data subject

Under POPIA you have the right to:

  • Be notified that we are collecting your information, and when it has been accessed without authorisation.
  • Request access to the personal information we hold about you.
  • Request that we correct or delete information that is inaccurate, irrelevant, excessive, out of date, or unlawfully obtained.
  • Object, on reasonable grounds, to the processing of your information.
  • Object at any time to processing for direct marketing.
  • Not have your information processed for direct marketing by electronic means without consent.
  • Not be subject to a decision based solely on automated processing.
  • Complain to the Information Regulator, and to institute civil proceedings.

To exercise any of these rights, email our Information Officer at info@jardinesgalleries.co.za. You may lodge an objection free of charge and through any reasonable channel; we will respond within a reasonable time and may need to verify your identity first.
